Hi,
We have download JavaME code from open source and ported to a device. We are going to put Java logo on top of the device.

Would anyone give me your advice of the following qusetions?
1. Should I get the authorization of Java logo from Sun? What process should I do to get the authorization?
2. Since we are using open source code base, can we free-distribute the ported code with a Java logo?
3. Is it MUST for our ported code pass TCK test? Is it only required if we need Java log? How can I get JavaME TCK test suite from open source?

Aling,

Thanks for contacting us. Here is the scoop:

To use the Java coffee cup logo you must license it from Sun and also pass all applicable TCKs for your Java ME port.

However, currently the TCKs are not freely available but must be licensed from Sun and maybe 3rd parties, depending on the JSR in question.

Finally, you *can* use the Duke image freely as it has been made available under the BSD license (https://duke.dev.java.net/).

Hope this helps,

Terrence,

Thank you for the reply.
Would you please give me a contact person for TCK licensing?

BTW, in addition to TCK testing, do you know what is next step for me to apply a logo? should I sign anything with Sun?

The answers to your questions are on the Java Technology Brand page. I don't know how you were supposed to have found this page by browsing java.sun.com. I found it after a frustrating 5 minutes of hunting by yahoogling "site:java.sun.com licensing java".

The summary is that yes you are required to get authorization from Sun on the use of Sun's logo's.. that's trademark law 101. The process is on the above page. And even if you're starting from the open source code, trademark law 101 says to use a logo owned by a particular entity you must contact them for rights to use that logo.. hence, go to Sun and play by whatever agreement we make you do to use the logo. One of the requirements is passing relevant TCK's.
